DUBOIS – A Luthersburg man waived his right to a preliminary hearing on Friday.
James Uhl faces charges with disorderly conduct and possession of drug paraphernalia. The commonwealth dropped the pending charge of possession of weapon on school property.
According to the affidavit of probable cause, a City of DuBois police officer assigned to the DuBois Area Middle School had been informed by a school employee of a suspicious man walking through the kids’ waiting area in the bus lane, and at the time was nearing the district office.
The officer stopped Uhl at the entrance to the school parking lot at Liberty Avenue. Uhl explained that he was just on the property to walk someone to the Jeff Tech bus, which was near the lunch room in the bus lane. According to Uhl, he did this to make sure the person made it to school as Uhl was worried about his grades.
The officer asked if Uhl had any weapons on him, and Uhl admitted that he did. He pulled out a blue lock-blade knife from his pocket. For safety reasons the officer then patted Uhl down and in the process discovered a blunt object in his front waist band area. Following Uhl being handcuffed, this object was revealed to be a glass marijuana pipe inside a cloth bag.
Uhl admitted, after being read his Miranda rights, that the pipe was used in conjunction with marijuana.
