DUBOIS – A 23-year-old DuBois man accused of headbutting a Sandy Township Police officer waived his right to a preliminary hearing on Friday.
Mark Byers of Brookville faces charges of aggravated assault, simple assault, driving under the influence, recklessly endangering another person, terroristic threats, disorderly conduct, reckless driving, obedience to authorized person directing traffic, and resisting arrest.
Those charges stem from an incident that took place on Sunday on 515 South Main Street in DuBois. Officers were investigating a three-vehicle accident and had the road blocked off. The affidavit of probable cause states that Byers was seen driving through the blocked off area. In the process of doing that, he nearly hit fireman Mark Sprague.
The vehicle came to a stop and Byers got out. Byers was approached by Sandy Township Police Officer Jason Gill. Byers was alleged to have started yelling at Gill and another officer. The officers attempted to take Byers into custody, and he headbutted Gill.
Both officers took Byers to the ground, and a number of firemen jumped in to help bring Byers into custody.
Byers was taken to the hospital for blood work to be done. During this time Byers asked Gill if he was afraid, “because I would be afraid of me because you’re dealing with me.”
Byers is free on $10,000 straight bail.
