S.C.A.R.E.D. Files for Extension for Briefs

DUBOIS – Sandy Citizens Arguing for Responsible Economic Development, or S.C.A.R.E.D. as they are more commonly known, have filed for a time extension to file briefs in their appeal.

S.C.A.R.E.D. is fighting a proposed Wal-Mart Supercenter to be constructed in Sandy Township, on the same site as the current Wal-Mart in the municipality.

Two months ago, S.C.A.R.E.D. filed the appeal, and their attorney Toni Cherry, has now applied to the Commonwealth Court for the time extension. Sandy Township Manager Richard Castonguay noted at Monday’s township supervisors’ meeting that the solicitor, Gregory Kruk, said such requests are often granted.

The Sandy Township Zoning Hearing Board and Developac Inc. have both been named in the suit as well.

The Court has twice dismissed the case of the citizens’ group.
