CLEARFIELD – A Morrisdale man accused of rape is facing additional sexual assault charges.
Andrew William Bailor, 24, was charged by state police on March 3 with rape, statutory sexual assault, three counts of aggravated indecent assault-less than 16 years old, three counts of aggravated indecent assault, two counts of corruption of minors and strangulation, all felonies, in addition to misdemeanor selling/furnishing liquor to minors.
On Wednesday, Bailor waived his right to a preliminary hearing, sending the case on to the county court. He posted $100,000 bail in this case.
On March 20 he was also charged with felony aggravated indecent assault-forcible compulsion and aggravated indecent assault without consent. His preliminary hearing for this case is scheduled for April 22.
According to the affidavit of probable cause in the first case, police were called to Mount Nittany Emergency Room where a victim was requesting a sexual assault examination.
She related that she was spending the weekend with a friend in July when Bailer stopped at that home in his ATV. He asked the victim if she wanted a ride, and because she had ridden with him in the past, she agreed to go with him.
While they were riding, he allegedly provided her with multiple alcoholic drinks and she became intoxicated. She asked to be taken back to her friend but Bailor took her to his residence instead.
She reported that he had touched her inappropriately on other rides. Once at his residence, she resisted his advances but he grabbed her by the arm and dragged her into his room. Here he allegedly ripped her jeans off and touched her private area while she repeatedly told him to stop.
The victim said he chocked her causing her to have difficulty breathing and to lose consciousness. He then reportedly undressed her and raped her. She stayed with him until the morning when he returned her to his friend’s residence.
The examination report listed multiple cuts, scratches and abrasions on various parts of her body including her arms, legs and back. Sperm was also found inside her, according to the criminal complaint.
In his interview with investigators, Bailor confirmed taking her for a ride but denied touching or raping her.
In a second interview, Bailor changed his story after he was provided the forensic information and stated the intercourse was consensual.
The second case involves a victim who came forward after seeing the original charges filed against Bailor.
According to that affidavit, she reported that when she was 14 years old, she was assaulted by Bailor who was giving her a ride home.
She stated that he pulled the vehicle onto a small gravel area near the intersection of Westville Road and Beechton Road in Jefferson County. He reportedly grabbed her chest and pushed her back against the front passenger seat. He then stuck his hand down the front of her leggings, she said. She told him to stop, but he didn’t.
They started to struggle as he inserted his fingers inside her, she told investigators. Again she yelled at him to stop, but he continued to assault her until she struck him in the side of the face with her hand. He then took her home without further incident.
When police consulted with Jefferson County Assistant District Attorney Kris Carlini, she suggested Bailor be charged in Clearfield County. Clearfield County Assistant District Attorney Tami Fees approved the charges.
