Penfield Man Sentenced for Selling Methamphetamine

CLEARFIELD – A Penfield man accused of selling drugs in two different cases, pleaded guilty during a special session of sentencing court Thursday.

Bryan James Pyne, 39, was sentenced by Judge Joshua Maines to serve six months to two years less one day in the county jail with two years concurrent probation for each of the two cases for possession with intent to deliver methamphetamine. The two sentences will run concurrent with each other.

According to the affidavit in the first case, on Oct. 19, 2023, a confidential informant contacted police saying he/she could purchase a “zip” of methamphetamine from Pyne for $600. It is noted that a “zip” is an ounce or 28 grams.

The informant was told by Pyne to stop by his home in Huston Township around 5:00 p.m. When he did, Pyne left the home to travel to Dan Prebble’s residence, also in Penfield to get the drugs. Pyne was observed by police driving to the other home and then returning to his own a few minutes later.

The informant reported that he/she gave Pyne the money provided for the purchase of methamphetamine. After he returned, Pyne gave the informant a clear plastic bag containing suspected methamphetamine.

In the second case which occurred a week later, an informant contacted Pyne about purchasing methamphetamine and was told to come to his home. Pyne again said he had to get the drugs from Prebble. He left at 5:17 p.m. and an officer spotted him at a retail store before he went to Prebbe’s home at 5:46 p.m. Another officer saw Pyne enter Prebble’s residence.

Meanwhile, the informant was waiting at Pyne’s home. He/she contacted him to see what was taking so long. Pyne told the informant that there were multiple people inside the home and he was “third in line”. Pyne explained that Prebble hid everything under a table because he did not want other people in his garage to know about the deal.

At this point the informant asked Pyne to bring the money back to him, but Pyne related that he had already given Prebble the $600.

It was approximately 8:21 p.m. when Pyne left Prebble’s residence, and he arrived back home at 8:27 p.m.

The informant told police after Pyne returned, he apologized for taking so long and gave him/her a baggie with a crystalline substance, suspected methamphetamine, in it.

Pyne further stated that Prebble was “extremely busy” and there was additional methamphetamine available if the informant needed more.

Prebble, 65, was charged by state police with four felony counts of manufacture/delivery/possession with intent to deliver a controlled substance in relation to these two incidents and an additional sale of 54.01 grams on Jan. 11, 2024, according to grand jury testimony.

Online court documents indicate he waived his right to a hearing on these charges on Jan. 16 with bail set at $100,000.

Prebble was scheduled for sentencing in two unrelated cases for simple assault and arson on Thursday but his attorney Jendi Schwab, asked for a continuance to allow her to examine the new offenses.

Maines agreed to continue Prebble’s cases until April.
