PINE CREEK TWP., Pa. (EYT) — A 64-year-old Brookville man is facing a felony aggravated assault charge after he allegedly chased two motorcycles for four miles and rammed one of them with his pickup truck in March.
Court documents show Timothy B. Zimmerman was arraigned on October 22 on a first-degree felony count of aggravated assault.
Zimmerman also faces multiple misdemeanor charges. These include three counts of simple assault, one count of recklessly endangering another person, one count of tampering with physical evidence, and one count of accidents involving damage to an attended vehicle. He was also charged with multiple summary traffic violations.
According to the criminal complaint filed by PSP Punxsutawney, the incident occurred on March 23 on State Route 322 in Pine Creek Township. Zimmerman allegedly became “irate” after two motorcycles passed his Chevrolet pickup truck. He then allegedly tailgated both motorcycles for approximately four miles.
One of the motorcyclists told police that after they passed the truck, the driver appeared “angry” and was “yelling and throwing his arm in the air,” the complaint states.
The motorcyclist said Zimmerman’s truck then sped up and followed “very close to my bike,” at an estimated distance of five feet, according to the complaint.
The victim told police he sped up to 70 to 90 MPH to get away, but the truck continued to follow closely, the complaint indicates.
Near the end of the chase, the victim said he “felt a nudge” and his rear wheel locked up. He reported to police that he believed his motorcycle “was embedded in the front of his truck,” which caused a 300-foot skid mark.
The complaint says the impact brought both vehicles from approximately 80 MPH to almost a complete stop. The victim was able to jump off the motorcycle uninjured.
Zimmerman then allegedly reversed his truck, drove around the victim and the downed motorcycle, and fled the scene, the complaint states.
Police later interviewed Zimmerman at his residence and observed damage to the front grill of his black truck, according to the complaint.
Zimmerman allegedly told police, “I was really overwhelmed by bikes” and “It was obviously a brake check.”
When police asked if the brake check resulted in him hitting the motorcycle, Zimmerman reportedly replied, “yes, yes, yes, yes sir.” The complaint says he also stated, “I don’t want to argue. I ****** up,” and “I realize I did something.”
Court records show Zimmerman was released on $40,000 unsecured bail. A preliminary hearing is scheduled for November 3.
