CLEARFIELD – A Cherry Tree man is facing charges for allegedly having an inappropriate sexual relationship.
Cody L. Schmoke, 26, is charged by Trooper Dennis Peters of the Clearfield-based state police with a felony sex offense and misdemeanor disorderly conduct.
On Wednesday Schmoke waived his right to a preliminary hearing during centralized court at the Clearfield County Jail. His bail is set at $10,000 unsecured.
According to the affidavit of probable cause, on April 3, 2018, state police were provided a child’s cellular phone that contained several pictures that were sexual in nature.
The pictures depicted Schmoke and a female from State College. The female was interviewed April 5, 2018 at the Clearfield-based state police barracks.
She reportedly admitted that she and Schmoke began their sexual relationship about a year prior when she was age 17, and it continued through January of 2018.
She said their sexual encounters occurred at residences in Cherry Tree as well as Sharon, and Schmoke had sexual photographs and videos of them, which she told him to delete.
On April 5, 2018, Schmoke was also interviewed and reportedly admitted that he began to have a sexual relationship with the female about 10 months earlier.
Schmoke also said he took video and photographs of their encounters. On Dec. 6, 2019, state police reviewed a phone download, and observed numerous photographs of sexual acts.
The female has also been charged with the same pair of offenses. She previously waived her right to a preliminary hearing, and her bail is set at $5,000 unsecured.
