Rockton Man Waives Hearing for Alleged Break-in, Assault

DUBOIS – A Rockton man accused of breaking into a residence and assaulting two people waived his right to a preliminary hearing Friday during centralized court in DuBois.

Mitchell David Kohler, 31, was charged by DuBois City police with burglary, criminal trespass, two counts of simple assault, criminal mischief and two counts of harassment after an incident on May 13 at 7:38 a.m.

According to the affidavit of probable cause, a male victim told police he heard a man yelling obscenities about the female victim outside the home. This man then climbed onto the back porch roof and looked at them through the open window.

This man, later identified as Kohler, broke through the screen, grabbed the man’s phone and threw it.

After climbing through the window, Kohler reportedly punched the man on the left side of his face with a closed fist.

He then went after the female victim and allegedly threw her into a door.

Police said the male victim got up and pulled Kohler from the female victim. Kohler then turned around and punched the male victim again, according to the report.

The female victim was able to run into the bathroom where she called 911.

The female victim told investigators that Kohler briefly pounded on the bathroom door before fleeing the residence.

She said Kohler was a friend of hers who was evicted from his residence last month. She stated that she let him stay with her until May 7 when she asked him to leave because he was trying to control her and they argued non-stop.

The male victim said he did not know Kohler prior to this incident.
