Hearing Continued for Philipsburg Man Charged with Assault, Resisting Arrest

CLEARFIELD – A Philipsburg man has been accused of resisting arrest and injuring a state trooper.

Eric Scott Heverly, 41, has been charged by Clearfield-based state police with felony aggravated assault, misdemeanor simple assault and resisting arrest.

On Wednesday Heverly had his preliminary hearing continued until 9:30 a.m. April 18. His bail is set at $75,000.

According to the affidavit of probable cause, on the afternoon of April 7, troopers responded to a report about neighbors yelling in the 200 block of Louisa Street, Philipsburg. Upon arrival, they made contact with Heverly and a female.

Troopers determined there had been a domestic dispute, during which a third-party was allegedly assaulted by Heverly. The third-party had left the scene prior to the state police’s arrival.

During an interview with troopers, Heverly made comments about harming himself. He was subsequently advised he’d be taken to the hospital for a mental health evaluation.

When a trooper put handcuffs on Heverly, he resisted by “jerking” his hands away. The trooper took him to the ground in order to restrain him, state police said.

A second trooper attempted to assist by controlling Heverly’s legs. He was able to get control of his left leg; however, Heverly allegedly kicked his right leg at the trooper, which hit the bridge of his nose and top lip.

Heverly was cuffed and transported from the scene. The injured trooper had minor swelling to his top lip and an abrasion on the bridge of his nose and top lip.
