Grampian Teen Waives Hearing in Sexual Assault Case

CLEARFIELD – A Grampian teen has been accused of sexually assaulting a 14-year-old girl who has autism.

Boeragard Allen Myers, 18, has been charged by the Punxsutawney-based state police with aggravated indecent assault without consent, F2; aggravated indecent assault/complainant unconscious or unaware penetration is occurring, F2; aggravated indecent assault/complainant less than 16 years, F2; unlawful contact with a minor/sexual offenses, F2; corruption of minors, F3; indecent assault without consent of other, M2; indecent assault person unconscious, M1; indecent assault/person less than 16 years of age, M2; and harassment, S.

Myers waived his right to a preliminary hearing during centralized court Wednesday at the Clearfield County Jail. His bail has been set at $50,000 unsecured.

According to the affidavit of probable cause, at 9 a.m. April 8, state police responded to a Burnside Township residence. The victim’s mother reported that Myers sexually assaulted her 14-year-old daughter. She also said that her daughter has “high-functioning autism.”

During an interview, the mother said at approximately 4:50 a.m., she and her husband were told “disturbing information” and that the victim needed their help.  State police also interviewed the victim in the presence of her mother.

The victim said she was sleeping when she was awoken by Myers. He was allegedly shining a flashlight at her private area and touching her inappropriately. At first, she said she felt confused and paralyzed, but when she gained her composure, she rolled to her side.

However, she said Myers followed her, which prompted her to get up and run from the room. She went into another room and told a relative what happened, and he went to her parents. When state police interviewed the relative, he corroborated the victim’s account of the incident.

Later that day, state police interviewed Myers, and he denied committing any of the crimes and requested a polygraph examination. On April 27, he submitted to a polygraph and confessed to the crimes.
