DUBOIS – Two people accused of selling cocaine to an undercover officer waived their rights to preliminary hearings Friday during centralized court.
Nicholas Noah McElwee, 21, DuBois, is charged with manufacture/delivery/possession of a controlled substance with a felony count of intent to deliver, felony criminal conspiracy, two counts of intentional possession of a controlled substance, possession of drug paraphernalia and a felony count of dealing in proceeds of unlawful activities. His bail was lowered from $25,000, monetary to $25,000, unsecured on Friday.
Hayden Leigha Cockrell, 19, was facing similar charges, but several charges were withdrawn. She is now only charged with felony counts of manufacture/delivery/possession of a controlled substance with intent to deliver and criminal use of communication facility. She remains in the county jail in lieu of $25,000, monetary bail.
According to the affidavit of probable cause, police met with a confidential informant to set up a controlled purchase of cocaine from Cockrell. The informant sent several text messages to Cockrell discussing a possible purchase by a friend who is an undercover officer. Cockrell gave a phone number that was used by the officer to arrange the purchase of two grams of cocaine for $200.
An undercover officer was able to complete this transaction when a car with both Cockrell and McElwee arrived at the pre-arranged parking lot.
The car was then stopped by other officers who saw the $200 used in the controlled buy in McElwee’s lap. Both of the suspects were taken into custody and searched.
A green leafy substance was found in Cockrell’s purse. In McElwee’s book bag they found a glass container with a white powdery substance, a scale and another small glass container with the residue of a green, leafy substance.
