CLEARFIELD – A DuBois man was sentenced Tuesday to state prison for selling methamphetamine.
Daniel Michael Toney, 30, pleaded guilty to possession with intent to deliver a controlled substance and criminal use of communication facility.
He was sentenced to nine months to three years in state prison by President Judge Fredric J. Ammerman.
It was noted that Toney is currently serving a nine months to three years sentence for violating his probation by committing this crime.
Ammerman said the new sentence will run concurrent with his revocation sentence.
Prior to sentencing, he addressed the court, admitting “I messed up big time” and detailing the number of programs he is completing at state prison. He thanked Ammerman for sending him to state prison for the revocation sentence.
“I now understand the effects of drugs,” he said. “It’s like pickling your brain and you just can’t go back.”
The charges stem from a controlled purchase of methamphetamine from Toney by a confidential informant on May 19, 2016.
According to the affidavit of probable cause, members of the Clearfield County Drug Task Force met with an informant that reported he/she could purchase a gram of meth from Toney for $200. The purchase was arranged by the informant calling Toney on his cell phone, using text messages and Facebook.
The informant and two undercover agents traveled to Spider Lake in Sandy Township where the buy was to take place. One of the officers got out in that area to provide surveillance on foot.
Prior to Toney appearing at the location, he and the informant had more communications in which Toney explained he needed the money before he would deliver him/her the drugs.
A white van drove into and parked in the same lot as the vehicle holding the informant and agent. Toney got out and walked to the restrooms. The informant got out of their vehicle and met him there. They talked for a few minutes before Toney went back to the van.
He then left the area. The informant let the officers know Toney left a cell phone behind as collateral until his return.
Toney drove to the nearby Garden Grove Townhouses and parked there. He then contacted the informant asking him/her to walk up the road to meet with him.
When he/she did, Toney handed the meth to the informant, according to the officer doing surveillance. The informant then returned to the vehicle and handed a plastic bag with a white crystal substance in it to the other agent.
When the substance was checked at a crime lab, it was confirmed to be 0.38 grams of methamphetamine, according to the report.
