DuBois Man Pleads Guilty to having Sex with Patient

CLEARFIELD – A DuBois man pleaded guilty to having a sexual relationship with a patient Tuesday during plea and sentencing court in Clearfield County.

Shane Patrick Stuckey Jr., 23, of 912 DuBois St., DuBois, pleaded guilty to three counts of institutional sexual assault. He was sentenced to two days to one year in jail and two years consecutive probation. He was fined $450 plus costs. Stuckey was ordered to complete the Project Point of Light program. He is not permitted to work with mental health or mental retardation patients.

Judge Paul E. Cherry warned him that if he didn’t complete counseling, he would be serving additional jail time.

The charges stem from an incident in August of 2011 at the Personal Habilitation Services in DuBois. According to the affidavit of probable cause, Stuckey had been texting naked pictures of himself to a patient. He was also engaged in sending and receiving vulgar messages from a patient.

The victim is considered disabled and suffers from intellectual issues along with mental issues. A further investigation revealed that the victim had sex with Stuckey at a Brady Street residence. An investigator felt that although the sex was not forced, that the victim was coerced by Stuckey.  During one of the times they had sex, the victim said she told him to stop because it was painful but he did not stop right away.   

In an interview, Stuckey did admit to having sex with her on a few occasions and he said it was a big mistake. While talking with police, Stuckey denied forcing sex on the victim. He also stated that he was in the process of getting help for his behavior.
