DUBOIS – A disorderly Michigan man found outside of the Best Western waived his right to a preliminary hearing on Friday before Magisterial District Judge Patrick N. Ford.
Justin P. Misiolek, 22, was taken into custody on Nov. 12 when police found himself outside the Best Western in cold weather wearing a T-shirt and blue jeans. Misiolek attempted to rent a room at the establishment, but had little money and no credit card. According to the affidavit, he was unclear to police as to where he was from or how he had gotten to DuBois.
Police checked with the clerk, who said the man tried to rent a room under an alleged credit agreement he believed his employer had with the motel. The clerk told him the company had no such agreement. The clerk said the man then became belligerent, calmed down and asked the clerk to look up names of people he believed were staying at the Best Western. The clerk told him none of the people he was asking about were staying at the motel. Misiolek then left, but returned, pounding on the lobby windows.
Officers on-scene reported that Misiolek was highly intoxicated.
After police took him into custody, Misiolek reportedly tried to slip his handcuffed hands from behind his back but became stuck. Officers got him untangled and placed him in a holding cell until he could be taken too Clearfield County Jail. While in his cell, Misiolek began smashing his head off of the cell door window, causing a bloody mess. Police contacted an ambulance crew to transport him to DuBois Regional Medical Center-West for treatment.
Misiolek waived charges of resisting arrest, disorderly conduct, public drunkenness and criminal mischief into court. The commonwealth withdrew the charge of simple assault. Misiolek was freed on $15,000 unsecured bail.
