PORT MATILDA – Diana Gray-Puit and Linda Puit of Glen Richey thought they were getting an ATV from Smith ATV and owner David Allen Smith. After making the down payment however, the women received nothing. Not an ATV nor reimbursement on the down payment.
Philipsburg-based state police report that after the women made the payment, Smith either closed or moved the business.
Smith was charged on Oct. 5 with two counts of theft by deception and one count of deceptive or fraudulent business practices.
A preliminary hearing was held in Smith’s absence on Nov. 1 after he failed to appear in court. Based on the testimony of one of the alleged victims, all charges were held to court in Centre County. A bench warrant was also issued for Smith’s arrest.
